Terms & Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern the provision of pilot training courses, self-fly hire and other services offered by North West Flight Training, a trading name of Fly Llanbedr Limited (company number 08866828), whose registered office is 49 Liverpool Road North, Burscough, Lancashire, L40 0SA.

By submitting a membership form, enrolling on a Course, or booking any service, you agree that these Terms become legally binding. In the event of any conflict between these Terms and any other document (including brochures, advertising material or website descriptions), these Terms shall prevail.

2. Definitions

In these Terms:

  • Aircraft – any aircraft owned or leased by us for training or hire.
  • CAA – the UK Civil Aviation Authority.
  • Course – any pilot training or related programme we offer.
  • Hirer – a person booking a self-fly hire aircraft.
  • JAA – Joint Aviation Authority.
  • EASA – European Aviation Safety Agency.
  • Operational Manual – the operational manual for the relevant Aircraft.
  • Pilot in Command – the person responsible for the safe operation of the Aircraft.
  • Pilot’s Operating Handbook – the operating handbook for the relevant Aircraft.
  • Premises – North West Flight Training, Blackpool Airport, UK.
  • Student – any person accepted onto a Course.

Interpretation rules:

  • Singular includes plural and vice versa.
  • References to legislation include amendments and replacements.
  • “Including” is illustrative, not limiting.
  • Headings do not affect interpretation.

3. General Course Terms

These terms apply to all Students on any Course. Students may only act as Pilot in Command if they hold the correct rating and meet recency requirements (either flown the type within 28 days or passed our 28‑day check).

Students must read and comply with the Operations Manual and Pilot’s Operating Handbook. You warrant that you meet all entry requirements for your Course and can provide evidence on request.

If any document you provide (passport, visa, medical certificate, licence, rating) is found or suspected to be false or forged, we may suspend or expel you without refund and notify the CAA and relevant authorities.

You must be entitled to reside in the UK and undertake the Course. If your visa status changes, you must inform the relevant authorities. We may also notify the visa issuer if you cease to be enrolled.

We retain Student details and may disclose them to the police, immigration authorities, the CAA and other relevant bodies.

Missed flying slots must be made up at your cost. Rescheduled flights are charged at the hourly rate in force at the time.

All flight, simulator and academic training is offered only as part of a Course. We are not obliged to provide training outside your Course structure.

Entry to regulatory examinations is at our discretion based on your demonstrated understanding and performance.

Assessment results may be held for up to seven years. Retakes may be offered at our discretion.

We make no guarantee regarding your ability to complete the Course, the time required, or the number of hours needed. Published completion times are averages only.

We may substitute Aircraft of equal or higher specification if required. We do not guarantee employment following Course completion.

4. Full‑Time and Part‑Time Courses

4.1 A Course may be completed on either a full‑time or part‑time basis. Once accepted, you will be provided with flying account details. All fees must be paid into your flying account in accordance with these Terms.

4.2 Part‑time Students will be charged for each flight at the standard hourly rate in force at the time of the flight.

4.3 Full‑time Course fees are those published at the time of enrolment.

4.4 For full‑time Courses:

  • (a) Students must complete nine hours per day, five days per week, unless otherwise stated.
  • (b) Students may be expelled if attendance falls below 90% in any calendar month.
  • (c) A roster will be provided before the Course start date.
  • (d) Up to two days off per month may be requested with 48 hours’ notice, provided no assessments or exams are scheduled.
  • (e) Daily schedules will be agreed the day before.
  • (f) Students will normally have two short slots (approx. 90 minutes) or one long slot (approx. 4 hours) per day.
  • (g) Failure to attend a slot without 48 hours’ notice may incur a £150 fee.

4.5 For part‑time Courses:

  • (a) Bookings may be made via the online booking system.
  • (b) Bookings may be changed due to operational reasons, especially before 17:00.
  • (c) A cancellation fee applies if cancelled with less than 48 hours’ notice (unless NWFT changed the booking within 48 hours).
  • (d) Cancellations must be made by email.

4.6 Rosters and schedules may be varied at short notice due to weather, ATC, regulatory requirements or aircraft maintenance. NWFT accepts no liability for postponements or cancellations.

5. Behaviour

5.1 Full‑time Students must maintain a high standard of dress and appearance.

5.2 Students must behave professionally and politely at all times. You are liable for any damage caused by you to NWFT or third‑party property.

5.3 Mobile phones are not permitted in classrooms or simulator areas.

5.4 Food and drink may only be consumed in designated areas.

5.5 Smoking is prohibited anywhere on the Premises.

5.6 Litter must not be left in or around the Premises.

5.7 Bicycles, packages and bags must only be left in designated areas.

5.8 Alcohol and illegal drugs are strictly forbidden on the Premises and must not be consumed within 12 hours of any flight, simulator session or ground training.

5.9 Breach of clause 5.8 may result in:

  • (a) immediate dismissal without refund;
  • (b) removal from the Premises; and/or
  • (c) an administration fee of £750.

5.10 NWFT may refuse to allow a Student to fly if they are deemed unfit due to alcohol, drugs, illness or any other reason.

5.11 You consent to ad‑hoc drug and alcohol testing. Blood samples will be taken only by qualified medical professionals.

5.12 NWFT equipment may not be used without approval. Faults must be reported immediately. No NWFT property may be removed without permission.

5.13 Violence or threats of violence will result in instant dismissal without refund.

6. Financial Terms

6.1 Prices for all Courses, lessons and experiences are published on our website and may be amended from time to time. Prices do not include landing fees unless stated.

6.3 Remaining fees for Courses or services are payable as notified, based on your flying account balance reviewed fortnightly.

6.4 Course fees are those published at enrolment. Fees may increase if third‑party costs (fuel, airport fees) rise, unless the full Course fee has been paid in advance.

6.5 If NWFT cancels a booking, we are not liable for any additional expenses incurred by the Student.

6.6 To reschedule a Course start date, 14 days’ written notice is required or the deposit/payment will be forfeited.

6.7 To reschedule training times, 48 hours’ written notice is required or a cancellation fee may apply.

6.8 Part‑time Students must remain in credit throughout the Course.

6.9 Additional training or airport costs will be charged at published rates.

6.10 If your flying account has insufficient funds, NWFT may invoice you. Invoices must be paid within 14 days. Interest may be charged at Bank of England Base Rate + 4%.

6.11 Unless an insurance excess waiver is purchased, you may be charged the insurance excess (or repair cost if lower) for damage caused by negligence.

6.12 NWFT is not liable for costs incurred due to diversions caused by ATC, weather or other external factors.

6.13 Courses may be suspended due to aircraft technical issues or regulatory reasons. Suspension does not alter payment obligations or entitle you to refunds.

6.14 If you fail to pay Course fees, NWFT may suspend your participation until payment is made. A £150 per‑day suspension fee may apply.

6.17 Fees are non‑refundable once a Course has commenced.

6.18 Students who leave a Course early are not entitled to any refund.

7. Hour Building

7.1 Details of what is included in the Hour Building Package are available directly from North West Flight Training.

7.2 A minimum number of hours, as advertised on our website, must be purchased and the corresponding amount placed on your flying account. The cost of each flight will be deducted from this account.

7.3 Standard rates apply to each flying hour unless NWFT offers discounts at its discretion.

7.4 Bookings should be made online after 20:00 the day before the booking is required. NWFT may rearrange or cancel a booking if the Aircraft is needed for another purpose.

7.5 Unless an insurance excess waiver is purchased, NWFT will charge the relevant insurance excess (or repair cost if lower) if an Aircraft is damaged through negligence.

8. Self‑Fly Hire

8.1 The Hirer is responsible for ensuring their rating is current and appropriate for the Aircraft type. NWFT accepts no liability for any failure to hold the correct rating. The Hirer indemnifies NWFT for any penalties, fines, costs or losses arising from such failure.

8.2 NWFT may require the Hirer to take a flight with an instructor before permitting solo hire. Instructor time will be charged at published rates.

8.3 A deposit must be paid before an Aircraft booking is confirmed.

8.4 Bookings may be made via the online booking system.

8.5 Booking times may be changed due to operational reasons, weather, ATC, regulatory requirements or aircraft maintenance. NWFT accepts no liability for postponements or cancellations.

8.6 A cancellation fee applies if the Hirer cancels with less than 48 hours’ notice. No fee applies if NWFT rearranges the booking within 24 hours and the Hirer cannot attend. Cancellations must be confirmed by email.

8.7 The Hirer must ensure that:

  • (a) all legal documents relating to the Aircraft, flight and Hirer are correct and on board if required;
  • (b) weight and balance calculations are completed before flight;
  • (c) the technical log is completed after the flight.

8.8 The Hirer is responsible for the Aircraft during the hire period, including any loss or damage. The Hirer must lock and secure the Aircraft at the end of the hire period. NWFT may claim for damages, including loss of revenue.

8.9 The Hirer is responsible for all aerodrome and navigation fees.

8.10 NWFT may request the Aircraft be returned at any time. The Hirer must comply promptly. Only the actual time used will be charged, and any unused prepaid fees will be refunded.

8.11 Unless an insurance excess waiver is purchased, NWFT will charge the relevant insurance excess (or repair cost if lower) for damage caused by negligence.

8.12 If the booked Aircraft becomes unavailable and no suitable alternative is available, the booking will be cancelled. NWFT accepts no liability for additional expenses incurred.

9. Trial Flying Lessons & Introductory Flights

9.1 Trial Flying Lesson and Introductory Flight vouchers are subject to this clause.

9.2 Vouchers are valid for 6 months from purchase. The voucher covers taxiing, flight time and taxiing after landing. Pre‑flight briefing time is additional.

9.3 Flights may take place in any NWFT Aircraft.

9.4 If a flight is not booked within the voucher validity period, the voucher becomes void without refund.

9.5 Bookings must be made by calling the number on the voucher or on our website.

9.6 Voucher holders must call on the day of the flight to confirm weather suitability. NWFT is not responsible for expenses incurred if a flight cannot take place due to reasons beyond our control.

9.7 If a flight cannot take place, the voucher holder may rebook within four weeks. If this falls outside the voucher validity period, no extra charge applies.

9.8 Bookings may be cancelled with 48 hours’ notice. Cancellations with less notice may incur a £30 fee.

9.9 Additional passengers may be carried subject to aircraft type and weight limits. NWFT has the final decision. If this is important, it must be stated at booking.

9.10 Vouchers may be upgraded to a higher value upon payment of the difference.

9.11 Vouchers may be refunded within 14 days of purchase, provided no flight has been booked.

9.12 Terms printed on the voucher or accompanying documentation are binding.

9.13 In the event of conflict, these Terms take precedence over voucher terms.

10. Variation

10.1 North West Flight Training reserves the right to amend these Terms at any time. We will endeavour to provide notification of such changes on our website.

10.2 No employee, agent or representative of North West Flight Training has authority to verbally modify or waive any of these Terms. Any modification or waiver is invalid unless in writing and signed by the Managing Director.

11. Liability and Indemnity

11.1 Nothing in these Terms limits or excludes either party’s liability for:

  • (a) death or personal injury caused by negligence;
  • (b) fraud or fraudulent misrepresentation;
  • (c) any liability which cannot be excluded or limited by law.

11.2 Subject to clause 11.1:

  • (a) North West Flight Training shall not be liable for any loss of profit, indirect or consequential loss arising under or in connection with these Terms;
  • (b) North West Flight Training’s total aggregate liability to a Student or Hirer in respect of all other losses shall not exceed the total amount paid by the Student or Hirer for the relevant Course or service.

11.4 North West Flight Training shall not be liable for any delay or failure to perform obligations due to events outside our reasonable control, including weather, ATC restrictions, regulatory changes, or aircraft technical issues.

11.5 Nothing in these Terms guarantees the availability of any specific Aircraft, instructor, or training slot.

11.6 You acknowledge that flying and flight training involve inherent risks. By undertaking training or self‑fly hire, you accept these risks.

11.7 These Terms do not affect your statutory rights.
